The largest reform of public procurement law in Germany in the last ten years has been completed. The corresponding EU regulation was implemented in April 2016 with an amendment to the Act against Restraints of Competition and the new Public Procurement Ordinance.
When awarding contracts for architectural and engineering services, clients must increasingly comply with their duty of care in project preparation (demand planning) (Section 132 (2) no. 3 GWB). If a client has not fulfilled his obligation to prepare the project (inadequate demand planning), regulations on compensation for damages may apply.
